The Demise of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the announcement of a new 28-article proposal for resolving the conflict appeared – briefly – to have been stabilised. A American diplomat spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its response: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, political struggles are conducted: hopeful statements are issued from multiple capitals. Considerable effort is devoted on containing certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "peace".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was exposed. Ukraine is able to track projectile deployments from Russian territory, a capability afforded by up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been scrambled to intercept incoming cruise missiles streaked across the sky – sophisticated military planes supplied to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons engaged: multiple launches deployed against a hostile projectile. This was a advanced protection mechanism at work, presumably delivered by partner states. Every launch jolts you unexpectedly, shaking the windows. The brief panic quickly becomes sober acceptance: perhaps the incoming missile won't hit its mark this time, preventing destruction from devastation and further power outages.

Ongoing Risks

Following this, a heavy machine gun fired at a unmanned aircraft close by, part of a defensive team – most likely imported technology. Regrettably, the bullets missed the enemy aircraft – it continued its flight toward its target.

Periodically, this persisted until dawn. Kyiv awoke to the early updates: seven people killed, devastation and utility failures in numerous residences as a result of the evening attack. As typically, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on external assistance – a dependence that regional partners are clearly incapable to replace in the immediate future.

Unsuccessful Negotiations

The detailed framework from US administration generated strong feelings, controversy and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and international summits.

Every new approach from US leadership adheres to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually win the battle. This trend will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse particular leaders of persistently promoting Russian terms. But that does not seem to be the complete picture. American leadership functions according to a principle familiar among seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The White House presumes that it is unrealistic to pressure the Kremlin to abandon the areas that it already controls in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, American administration does little to prevent Kremlin actions, through words or deeds, from believing that the current condition will not evolve additionally in its advantage in the months ahead.

Conflicting Perspectives

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its partners are nearing depletion. Their reason to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing lives and land but averting a complete military breakdown until situations evolve in its advantage.

Present Conditions

Factually, there are no genuine requirements for a ceasefire. Now, individual motivations are coming into play: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any plan Kyiv finds unacceptable, so that their focus does not switch to homefront challenges. And although their mission will now be considerably more difficult after current events, it remains highly unlikely that this will change their overall approach.

These opposing factors are influencing discussions.

Assessment and Future

It took a only one week to eliminate the 28 points of the latest plan. Assertive and inconsistent approach of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, current information leaks, all did their job.

While new initiatives based on previous concepts are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and demonstrate particular unwillingness to alter the situation, if they maintain solidarity and improve their protective measures at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the coming months, primarily depend on continued Western support.
